PASSENGER TRAVEL PROTECTION PLAN

General Provisions

Certificate of Protection

You are covered for the benefits described in this form as long as the appropriate premiums have been paid. Keep this *P.T.P.P. with your important papers. It is the description of the coverage provided. All information contained on this certificate is subject to the terms and conditions of the *P.T.P.P.

Definitions

As used in this certificate

1. “You” and “your” mean the name shown in the schedule.

2. “We”, ”us” and “our” mean Your Man Tours, Inc.

3. “Protected property” means personal effects while in transit or while in a hotel or other building during a trip anywhere in the world. The personal effects must be owned by you. The term “personal effects” as used herein does not include the following:

   (a) animals

   (b) automobiles

   (c) motorcycles, boats, motors, or other conveyances or their equipment

   (d) bicycles

   (e) contact lenses or artificial teeth or limbs

   (f) money, securities, tickets or documents

   (g) property shipped as freight.

4. Sickness. Means an illness or disease which is diagnosed or treated by a physician after the effective date of coverage and while you are covered under this policy.

5. Injury. Means the bodily injury caused by an accident occurring while this plan is in force and resulting directly and independently of all other causes in loss covered by this plan. The injury must be verified by a physician.

   

Notice of Claim

We must receive written notice of claim at our offices as soon as possible after any covered loss occurs or begins. We would like notice within twenty (20) days if possible. Notice given by you should have enough information to let us identify the covered family member.

Claim Forms

When we receive notice, we will send you forms for filing proof of loss. If we do not send forms within fifteen (15) days after notice, our requirements will be met if we receive written proof of the event and the type and extent of the loss within the time stated below.

Proof of Loss and Time of Payment of Claims

We must receive written proof of loss within ninety (90) days after the date of loss. If it is not reasonable to give this timely proof, the claim will not be affected if it is sent in as soon as possible. We will not accept proofs nor pay any benefits if proofs are sent more than six months after we have received notice of claim, unless you lack capacity. Benefits payable under the *P.T.P.P. will be paid as soon as due written proof of loss is received.

No Show

Notification within 48 hours or less of departure is considered a no show and no refund will be made.

Changes

No person other than one of our officers can, for us, waive any terms or provisions of the *P.T.P.P.

Trip Interruption/Cancellation Coverage

Benefits

We will, if during the term of coverage, a covered family member is prevented from participating in all or part of the trip because of:

    injuries, sickness, or the death of an immediate family member. The injury or sickness must be so disabling as to reasonably cause a traveler to delay, cancel or interrupt a trip,

pay the following benefits;

 1. Pre-Departure Cancellation

In the event of cancellation, the amount of non-refundable money paid by a covered family member for participation on the trip, less the non-refundable deposit.

2. En route Interruptions

The loss of any travel arrangements that were part of the trip.

3. Curtailment and Return

The amount of nonreturnable land or sea arrangements that were paid as part of the trip at the original price. Any additional costs incurred will be at the customer’s expense. Example: additional hotels, airfare, etc.

Aggregate Limit of Payment

For all losses payable under the *P.T.P.P., we will not, in the aggregate, pay more than the *P.T.P.P. limits. Payments for trip cancellation are limited to the amount paid. Limit for trip interruption is $1500.00

General Exclusions

We will not pay the benefits of the *P.T.P.P. for any loss because of:

1. The treatment, services or care rendered by a physician, surgeon or trained nurse who is a member of the family of any covered family member; or

2. Acts of God; or

3. The loss caused by cancellation resulting in a single room supplement charge.

 

Travel Baggage Protection

Term of Coverage

Your coverage begins on the departure date. The term ends upon , whichever occurs first,

1. Arrival at your home, or

2. 11:59 PM on the last scheduled day of the tour.

Exclusions

We do not cover the following:

1.  Loss or damage caused by wear and tear, deterioration, insects, vermin or inherent vice;

2.  Loss or damage to property from being worked upon;

3.  Loss or damage caused by

      (a) war, including undeclared war, civil war, insurrection, rebellion or revolution;

      (b) warlike act by any government or military force or personnel;

      (c) destruction or seizure under quarantine or custom rules;

      (d) seizure by order of any government;

      (e) risks of illegal transportation or trade;

4.  Loss or damage to property specifically insured under other insurance;

5. Loss or damage to jewelry, watches or cameras/camera equipment; articles consisting in whole or in part of silver, gold, or platinum; or articles trimmed with or made mostly of fur; eyeglasses or contact lenses; artificial teeth and dental bridges; hearing aides; prosthetic limbs; money and securities; tickets and documents; sporting equipment;

6.  Loss caused by or resulting from breakage of brittle or fragile articles; cameras, musical instruments, radios and similar properties, baggage wheels and wheel assembles; theft or pilferage while left unattended in any vehicle; mysterious disappearance;

7.  Loss or damage of goods purchased throughout the duration of the cruise/tour.

 

Conditions

1. Your duties after loss or damage to property

In case of loss or damage to which this coverage may apply, you must see that the following duties are performed:

      (a) notify us as soon as possible,

      (b) take all reasonable steps to protect, save or recover the property,

      (c) Promptly notify either the police, hotel proprietors, cruise lines, railroad or station authorities, airlines or any carrier or bailee in whose custody the insured property was at the time of the loss,

      (d) give us, within 90 days from the date of loss or damage, a detailed proof of loss signed and sworn to by you,

      (e) produce pertinent records needed to verify the claim and its amount and permit copies of such records to be made if needed.

2. Payment of Claim

Any claim covered under this program will be adjusted and paid when you give us satisfactory proof of the loss or damage. Any claim for lost property covered under the *P.T.P.P. will be adjusted and paid when the property is not found after a reasonable time.

3. Loss Settlement

We will not pay more than the least of the following amounts:

      (a) the actual cash value of the property with proper deduction for depreciation at the time of loss or damage;

      (b) the amount for which the property could be restored to its condition prior to the damage;

      (c) the amount for which the property could be replaced with property of like kind and quantity.

The coverage limit for Baggage Protection is $500.00 per plan.

4. Reduction in Amount of Protection

The coverage limit for this protection shall be reduced by the amount of any loss or damage covered under this plan.

5. Action Against YMT

No action may be brought against YMT unless it is started within 6 months after you first learned of the loss or damage.

6. No Benefit to Bailee

This protection shall in no way benefit any carrier or bailee.

7.Concealment or Misrepresentation

This entire coverage will be void if, before or after a loss, you have concealed or misrepresented any material fact or circumstance relating to this protection.

8. Claim Against Others

In the event of loss or damage that we believe may be collectable from others, we may pay in the form of a loan to be repaid out of any recovery from others. You will cooperate in every way possible to assist in such recovery from others. We will, at our expense, take over your rights against others to the extent of our payment.
